Employer requirements for LMIA

Job Offer: Employers must have a legitimate job offer for a position requiring a foreign worker.

LMIA Application: Employers need to submit an LMIA application to ESDC. This involves providing detailed information about the job, the company, and the efforts made to hire Canadians for the position.

Advertising and Recruitment: Employers must advertise the job to Canadians for a specified period before applying for an LMIA. The advertising must meet specific criteria and be conducted in a manner that reaches potential Canadian workers.

Fee Payment: All LMIA applications must include a non-refundable processing fee of $1000.

Francophone Mobility

Francophone Mobility is a part of Canada’s immigration policy to encourage and facilitate the migration of French-speaking individuals to Canada. The goal is to enhance the vitality of Francophone communities outside of Quebec and to support the broader promotion of the French language and culture in the country.

If the French-speaking or bilingual foreign worker an employer wants to hire meets the eligibility requirements, they can be hired without an LMIA.

Employer requirements for Francophone Mobility

  • Submit an offer of employment through the Employer Portal using LMIA exemption code C16 for Mobilité Francophone
  • Pay a $230 employer compliance fee
  • Provide your worker with their offer of employment number: a 7-digit number they will require for their application.

After completing these steps, the employee can apply for a work permit.
