Changes to Temporary Foreign Worker Program

Recently, updates were made to Canada's Temporary Foreign Worker Program

Canada’s Temporary Foreign Worker Program plays a crucial role in addressing labor shortages across various industries by allowing businesses to hire skilled workers from abroad when local talent is insufficient. Recent updates to the program aim to enhance transparency and fairness while ensuring that both Canadian workers and employers benefit equitably.

Recently, changes to this program were announced by the Canada government. 

Changes to Labour Market Impact Assessments

Effective May 1, 2024, new LMIAs will see their validity period reduced to six months, down from the previous 12 months. This adjustment ensures employers and policymakers access more current data on labour market needs, enabling them to make informed decisions regarding workforce planning and recruitment strategies.

Reduction in TFWP

Employers listed in the 2022 Workforce Solutions Road Map will experience a reduction from 30% to 20% of their total workforce eligible for the Temporary Foreign Worker Program, particularly under the low-wage stream.

Exceptions are granted for critical sectors such as construction and healthcare.

Moreover, employers are encouraged to exhaust all local avenues before resorting to the TFW Program. 

Annual Wage Reviews for Temporary Foreign Workers

As of January 1, 2024, employers are mandated to conduct annual reviews of wages for temporary foreign workers to ensure alignment with prevailing wage rates in their respective occupations and regions of work. These reviews guarantee that foreign workers are fairly compensated throughout their employment tenure. In cases where wage adjustments are necessary, they are typically increased to match prevailing rates.

More Permanent Residency Through Domestic Draws

Canada’s Immigration Minister, Marc Miller, has announced an important plan to make it easier for temporary residents already living in Canada to become permanent residents. This plan involves something called “domestic draws,” which are like special selection rounds in programs like Express Entry.

In these draws, eligible candidates will be chosen based on factors like their job skills, work experience, and language abilities. The idea is to give priority to those who are already contributing to Canada’s economy and society.

By doing this, Canada hopes to make it simpler for temporary residents to stay permanently while easing pressure on important sectors like housing and healthcare.
